New Statute of Limitations Bill Introduced
Single section bill seeks to put Michigan engineers & architects in line with other states -
10/2/2009
Senator Alan Sanborn has introduced a new bill (SB 882) that seeks to correct a Michigan Supreme Court decision and return a 2-year statute of limitations for malpractice claims against professional engineers, surveyors and architects.
The Michigan Supreme Court failed to see a distinction between the statute of repose and statute of limitations thus raising the limit to 6 years, longer than all of the other states. The bill provides clarity between the statutes and will return the limits to 2 years for engineers, which it had been for 100 years prior to the Supreme Court decision.
ACEC will be strongly supporting the bill and pushing for passage this session. Please click below for a copy of the bill.
